Nityasha Partner App - Terms and Conditions
1. Definitions
Company refers to Nityasha and its affiliates. Partner refers to individuals or entities registering on the Nityasha Partner App to provide services. User refers to customers using Nityasha’s platform to avail of services. Platform refers to the Nityasha Partner App and website.
2. Eligibility
Partners must be at least 18 years old and legally eligible to provide services. The Company reserves the right to verify documents, background, and qualifications before approving a partner.
3. Partner Obligations
The Partner must provide accurate information during registration and update it as necessary. The Partner agrees to follow ethical and legal business practices. The Partner must fulfill services in a professional and timely manner. The Partner shall not misrepresent, defraud, or mislead customers.
4. Service Fee & Commission
The Company reserves the right to set and modify the commission structure. Payment to partners will be processed as per the Company’s payment cycle. Any disputes regarding payments must be raised within 7 days.
5. Compliance & Legal Responsibilities
The Partner must comply with all applicable laws and regulations. The Partner is solely responsible for obtaining necessary licenses or approvals. The Company holds no liability for the Partner’s non-compliance with legal obligations.
6. Termination
The Company reserves the right to suspend or terminate a Partner’s account at its discretion for: Violation of terms and conditions, Customer complaints, Misconduct or fraud, Non-performance or breach of agreement. The Partner can request account termination, subject to a settlement of pending dues.
7. Limitation of Liability
The Company is not liable for any indirect, incidental, or consequential damages arising from Partner’s service delivery. The Partner agrees to indemnify and hold the Company harmless against any legal claims, damages, or losses.
8. Intellectual Property
The Nityasha logo, brand name, and platform are the sole property of the Company. Partners are prohibited from using the Company's intellectual property without written consent.
9. Privacy & Data Protection
Partners must maintain the confidentiality of customer data. Unauthorized sharing or misuse of user data will result in termination and legal action.
10. Modification of Terms
The Company reserves the right to modify these terms at any time. Partners will be notified of any significant changes and continued use of the platform will constitute acceptance of revised terms.
11. Governing Law & Dispute Resolution
These Terms and Conditions shall be governed by the laws of India. Any disputes shall be resolved through arbitration in [Guna, MP], as per the Arbitration and Conciliation Act, 1996.
